Terms and Conditions of Participation in the Pavluks Trans bonus Loyalty Program
These Terms and Conditions for participation in Pavluks Trans loyalty bonus program (hereinafter referred to as the Terms and Conditions) establish the procedure for relations between Pavluks Trans and program participants, the period, conditions and procedure for participation in the Pavluks Trans Loyalty Bonus Program (hereinafter referred to as the Program).
1. Terms and Definitions
- 1.1. The Program Organizer (Organizer) is Pavluks Trans.
- 1.2. Program Participant (Participant) is a legally capable individual whose account is registered in the PavluksApp mobile application and/or on the website https://pavluks-trans.com.
- 1.3. Services - services for booking, issuing and selling tickets for flights and additional services (luggage space) provided by the Organizer in the PavluksApp mobile application and/or on the website https://pavluks-trans.com.
- 1.4. The Pavluks Trans Loyalty Program (Program) is a bonus program aimed at rewarding the Participants who are provided with special conditions for receiving the Services. The Program is not a game of chance, lottery, or gambling service.
- 1.5. Bonus Point (Bonus) is a conditional unit credited to the Participant’s Bonus Account and debited from the Participant’s Bonus Account in accordance with these Terms and Conditions. Bonuses are used for accounting purposes only and are not and may not be any type of cash or securities.
- 1.6. Bonus Account is a section in the Personal Account of the User - Participant containing information about the number of Bonuses accrued (received) and/or debited (used) by the Participant, as well as the current bonus balance (bonus balance). The Bonus Account is not a bank account. Bonuses credited to the Bonus Account and debited from the Bonus Account are credited to the Bonus Account in accordance with these Terms and Conditions.
- 1.7. Personal Account means a personal section of the Participant in the PavluksApp mobile application and/or on the website https://pavluks-trans.com, which can be accessed only after entering a login and password.
2. Main Provisions
- 2.1. The Program is conducted by the Organizer indefinitely.
- 2.2. The Terms and Conditions contain a list of conditions required for participation in the Program.
- 2.3. By performing actions aimed at joining the Program and obtaining the right to receive Services using Bonuses within the Program, the Participant hereby confirms that he/she has read these Terms and Conditions, unconditionally accepts the terms of participation in the Program, agrees and undertakes to comply with them.
- 2.4. The Organizer reserves the right to make any changes and amendments to the Terms and Conditions, in particular, to change the name of the Program, design, number and system of Bonus Points accrual, the procedure for purchasing Services using Bonus Points, which will be notified to the Participants on the website https://pavluks-trans.com and/or in another way (for example, by sending a notification of changes and amendments to the Terms and Conditions in the PavluksApp mobile application or to the email address specified in the Participant’s account). If the Participant continues to participate in the Program, it is considered that the Participant has read and accepted the changes and additions.
- 2.5. The Organizer also reserves the right to add/remove/change the list of Services, the number of Bonuses required to receive a particular Service. The Participant independently receives information about the changes made by reading the current version of the Terms and Conditions.
- 2.6. In case of violation of the Terms and Conditions by the Participant, the Organizer sends the Participant a notice of the nature of the violation and proposals for the Participant to eliminate such violation. The Organizer has the right to unilaterally block the Participant’s Bonus account and exclude him/her from the Program.
- 2.7. The Participant has the right to receive information about the Program in one of the following ways: on the website https://pavluks-trans.com; by contacting 380674845727 or by e-mail [email protected]; in any other way.
- 2.8. The Participant has the right to receive information about the Bonus Account balance in the User’s Personal Account on the website https://pavluks-trans.com, and/or in the PavluksApp mobile application.
- 2.9. The Organizer may decide to terminate the Program at any time and for any reason, at least 1 month before the scheduled date of termination of the Program, by notifying the Program Participants through the website https://pavluks-trans.com and/or in another way (for example, by sending a notice of termination of the Program in the PavluksApp mobile application or to the email address specified in the Participant’s account). Such notice shall contain the terms of the Program termination, as well as the deadline(s) for receiving the Service in exchange for Bonuses.
3. Rules for Accrual and Use of Bonuses
- 3.1. The Organizer credits Bonuses to the Participant’s Bonus account for the Services that the Participant purchases in the PavluksApp mobile application.
- 3.2. Subject to full payment of the cost of the Service purchased by the Participant in the PavluksApp mobile application, the Participant is awarded Bonuses in the amount of 10% of the Service cost, at the rate of 1 UAH = 1 Bonus. Rounding of Bonuses to be credited is carried out according to generally accepted mathematical rules to the nearest whole number.
- 3.3. In case the Participant purchases the Service at a promotional price, including, but not limited to, the purchase of a discounted child ticket, the Bonuses are not credited to the Participant.
- 3.4. Bonuses are credited to the Participant’s Bonus Account automatically and immediately after full payment of the Service cost purchased by the Participant in the PavluksApp mobile application.
- 3.5. Claims for Bonus Points accrual are accepted from the Participant in writing by e-mail to [email protected].
- 3.6. The Bonuses credited to the Participant shall become available for settlement immediately after they are credited to the Participant’s Bonus Account, have no expiration date and may be used by the Participant at any time to pay for part or all of the Service cost in the PavluksApp mobile application.
- 3.7. Bonuses credited to the Participant’s Bonus Account may not be transferred or assigned to another person or used in any other way, except as provided for in these Terms and Conditions.
- 3.8. Full payment of the Service cost by the Participant at the expense of accumulated Bonuses means the purchase of the Service by the Participant for UAH 1 (one) and debiting Bonuses from the Participant’s Bonus Account in the amount corresponding to the full cost of the Service at the rate of UAH 1 = 1 Bonus. Rounding of the Bonuses to be debited is carried out according to generally accepted mathematical rules to the nearest whole number.
- 3.9. The amount of Bonuses used by the Participant to pay for the Ticket Purchase Services shall be returned to the Participant’s Bonus Account when the Participant returns the ticket, but subject to the terms of ticket refund set forth in the Public Offer Agreement posted on the website https://pavluks-trans.com, and, accordingly, shall be refunded to the Participant: 85% of redeemed Bonuses in case of voluntary ticket refund more than 48 hours before the flight departure; 75% of redeemed Bonuses in case of voluntary ticket refund more than 24 hours before the flight departure; 50% of redeemed Bonuses in case of voluntary ticket refund more than 12 hours before the flight departure; 15% of redeemed Bonuses in case of voluntary ticket refund more than one hour before the flight departure. Tickets are not allowed to be refunded less than one hour before the flight departure.
- 3.10. In case of cancellation of the Service and return of the ticket purchased by the Participant in the PavluksApp mobile application without using Bonuses, the Bonuses in the amount of 10% of the full cost of the Service paid by the Participant are cancelled.
- 3.11. In case of a negative value (debt) on the Participant’s Bonus Account as a result of payment by the Participant for the Services with Bonuses, the accrual of which was subsequently cancelled due to the Participant’s refusal from the Services and refund of tickets for the purchase of which such Bonuses were accrued, the Bonuses shall be accrued in accordance with these Terms and Conditions, but cannot be used by the Participant until the debt is closed and the Bonuses are available on the Participant’s Bonus Account in an amount greater than zero.
4. Other conditions
- 4.1. The Program is intended solely for the personal use of persons who are Program Participants.
- 4.2. The Participant shall be responsible for any actions of the third parties that occur when the login and password required to enter the Participant’s Personal Account and/or his/her PavluksApp mobile application are entered correctly.
- 4.3. The PavluksApp mobile application is available for download in the AppStore and Google Play.
- 4.4. Participants who participate in the Program must read and comply with these Terms and Conditions.
